Conditions of access

The use of this web site is subject to the terms and conditions of use as set out below. It incorporates the privacy and security policy as amended from time to time, and it is important that the user reads and understands the terms of use applicable to the EB Sport Promotions CC’s ((hereinafter “EB”)) ‘everythingbicycling.co.za’ web site (hereinafter “the site”).

 

Amendments to conditions

  • EB may amend these conditions and policies from time to time without notification to the user.
  • The current version of these conditions will govern the respective rights and obligations of EB and the user each time the user access this site.

 

Acceptance

We define a “user” as either a browser, visitor, guest or member, and assume that these terms (and conditions of use) become effective and binding upon acceptance thereof bysuch user, which terms, conditions and policies constitutes the whole agreement between EB and the user, as amended from time to time.

 

Information on this site

  • All information on everythingbicycling is intended to provide information about bicycling, cycling events, - services, accessories and related matters. These services are made available for both personal and commercial use.
  • All information regarding the product sand services (including the terms and conditions, rates/fees or any other matters), is subject to change without notice.

 

Services

  • The available services featured on the site are subject to a user’s registration (confirming acceptance of these terms), which registration EB may accept or reject in our sole discretion.
  • The online services are subject to additional terms and conditions set out in the relevant sections of this policy, and might even be distinct arrangements between a user and  a 3rd party (such as when you would enter an event).
  • In the event of conflict between these terms and conditions and the service terms and conditions contained in this section, the provisions of the individual service terms will apply.

 

3rd party information / linked sites

  • EB uses the services of 3rd party/s and/or organisation/s to provide and make information available on this site. We have no control over such information or any links contained in a linked site, or any changes or updates to a linked site, and we expressly make no representation/s or warranty/ies of any nature as to the content, its accuracy, appropriateness or correctness. We will not accept any liability for any damages that may arise from the user's reliance on the information contained in this site.
  • EB is neither responsible for web casting or any other form of transmission from linked sites, nor do we accept any responsibility if a linked site is not working.

  • If any third party wants to establish a hyperlink, frame, metatag or similar reference, whether electronically or otherwise (collectively referred to as linking) to this site, EB  prior written consent is required.   • any reproduction of material from this site (or portion of it), must include due copyright acknowledgement, and nobody may  take the results, logo’s trademarks or formats,  reformatted display/s of or mirror the pages contained herein, unless agreed to in writing.
  • This site may not be linked to without the express consent of EB, which consent shall not be unreasonably withheld.
  • Nothing on this site should be construed as granting a licence, permission or right to use any trademark, logo, design or format without the title holder’s prior written permission.

 

Sending of information

  • It is recorded that information transmitted through / over the Internet, including e-mail, is subject to potential unlawful access or monitoring.
  • The user accepts that EB  will not be held liable for any loss or damage suffered by the user as a result of unlawful / negligent activities by others, as we cannot prevent such behaviour despite reasonable steps having been taken in accordance with best business practise.
  • EB  may request independent verification of any information transmitted by the user through the site or e-mail from time to time, to limit such risks.

  • any and all responsibility or liability for the accuracy, content, completeness, legality, reliability or operability or availability of information or material displayed.
  • any harm resulting from downloading or accessing any information or material from  us.
  • any responsibility for deletion, failure to store, mis - or untimely delivery of any information or material.
  • any delay or failure in performance resulting directly or indirectly from acts of nature, or forces or causes beyond its reasonable control, including – but not limited to – internet failure telecommunication failure, other equipment failure, electrical power failure, strikes, labour disputes, riots, insurrections, civil disturbances, fires, floods, storms, explosions, acts of God, war, non performance of 3rd parties or any  similar events.
  • any warranty, condition or undertaking that the content contained herein is will be uninterruptible or error free.

 

Capacity to enter into agreements

  • The user hereby warrants to EB that it has the capacity to enter into and be bound by these terms and conditions. (Minors must be assisted by their legal guardians when reading and accepting the site's terms and conditions.)

 

Termination, suspension and limitation EB  may, unilaterally:

  • set limits or conditions on the right to certain services, features or functions on this site,
  • restrict access to parts of or all of the services on the site,
  • modify, suspend or discontinue this site, whether temporarily or permanently, without notice,

User communication

The user acknowledges that EB  will use e-mail and notices on this site as its communication tool regarding all issues relating to this site, its terms and conditions of use.

 

An e-mail message will be deemed to have been sent:

  • by the user, at the time at which EB  are capable of accessing such message;
  • by EB , at the time shown on the message as having been sent, or if not so shown, at the time shown on EB ’ system/s as having been sent.

 

An e-mail message is deemed to have been received:

  • by the user once it becomes capable of being retrieved by the user;
  • by EB, once they have confirmed receipt thereof to the user, or responded thereto, whichever is the earlier.

A message shall be attributed:

  • to the user, if it purports to have originated from the user, irrespective of the fact that someone else may have impersonated the user or whether the message sent to EB  resulted from an error or malfunction in the relevant communication system;
  • to EB, if it has been sent by a duly authorised representative and such representative acted within the scope of such authority, or by an automated system programmed by EB  and which system operated without error or malfunction.

 

General provisions

  • The terms and conditions pertaining to any products or services appearing on this site or pages shall be governed and interpreted in accordance with the laws of the Republic of South Africa, and an application for any of the products or services offered on this site will constitute the users consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of the terms and conditions pertaining to this site or such products or services.
  • A certificate signed by a member of EB  – whose authority need not be proven - will constitute sufficient proof of the operation or functionality of the online services or any part thereof and the contents of any information displayed on the site on a given date, and will be regarded as correct unless proven to the contrary.
  • The headings of the clauses in the conditions is provided for convenience and ease of reference only and will not be used to interpret, modify or amplify the terms.
  • EB may cede or assign any right or obligations arising from this agreement, without notice.
  • EB reserves the right to modify these terms and conditions from time to time – without notice – and we may terminate our services from time to time without notice or any liability to any 3rd party.
  • Where any dates or times need to be calculated in terms of the conditions, Johannesburg - South Africa's - standard time shall be used.
  • No failure or delay by EB  to exercise any of its rights will be construed as a waiver thereof, whether this is done expressly or implied, nor will it affect the validity of any part of the terms and conditions hereof, or  prejudice the right to take action.
  • If any of these terms and conditions is held to be invalid, unlawful or unenforceable, such term will be regarded as pro non scripto, separate from the remaining terms and conditions that will continue to be valid to the full extent permitted.

 

Browser requirements, font and site design

Our site is best viewed by using Internet Explorer 6.0 SP 1 (or similar). This website is best viewed at 800 X 600 resolution. This can be done by

  • right clicking on your “desktop”,
  • selecting “properties” and “settings”.
  • Under "screen" you can change the screen resolution to 800 X 600, which will make everything on your screen larger (unless your screen is already set to 800 X 600).

Please note that once you click "apply" or "OK" this will change the screen resolution for your PC and all it's applications. PC settings can be changed back at any time later by following the same procedure.

 

 

PRIVACY POLICY

Our commitment to users and visitors of the everythingbicycling website is that EB does not & will not intend to sell or provide personal user information to third parties for independent use. Personal information collected via the site is stored in a secure environment, with restricted, supervised access.
We are as just as irritated with spam as you are, and EB  is committed to maintaining the privacy and security of user’s' information.
 
 

What is ‘user information’?

User information refers to personal and private information submitted to and collected by that identifies, profiles or relates to a user, event or cycling product. This information includes details such as name, age, ID, registration numbers, addresses and contact details, payment records, financial information and relevant details, and includes  - but is not limited to – URL, IP - address, browser - type and -language, the date and time of visit as well as a log of requests entered.
We aim to provide customized 3rd party content and advertising opportunity and search & result reports aimed to assist all cycling investment/s.

 

Cookies

The site uses "cookies”, small data packages / text file given to the user’s browser by our web server when visiting us. The ‘cookie‘ is stored on the user’s browser and a packet of information is sent back to our web server each time a user visits. Cookies do not gather information or function independently, and cannot collect any personal information or data or information about what the user does, but merely enables us to provide a more valuable online experience.

 

Why does EB  collect user information?

EB  uses user information to identify and profile the visitor/ user, enabling us to provide a better online experience / service. We are very proud of our site, and with a little bit of your information we believe we can make a large difference.
In addition, we require basic information to contact you in the event of a problem or query, and can be used to bring details of services and products for which you have subscribed to your attention.  Relatively sensitive information is on occasion requested to allow for profiling of visitors, in order to enable generic reports to some of our customers.  The most obvious reason why we collect ID information is to allow data-integration with other bodies, for verification and/or field-population purposes.

EB will not use user information without obtaining the user's consent, which consent may be express or implied. The type of user information the user will be asked to provide will vary according to the product or services required, as some of our customers contact us for profiled, generic reports and values.

EB will - in all instances required by law - disclose the information specifically requested.
 
In the public interest

EB might be requested to provide user information for matters of public interest, such as to assist in the prevention of crimes. We will take reasonable precautions to ensure such assistance with authorities have legitimate grounds.

Where information disclosure is contracted between a user and a third party

In the event where you might enter an event through us, relevant information will be disclosed to the event organiser, their agents or successsors in title.

Sale of business

In the event that this business is sold or integrated with another business, the compiled databases will form part of such transaction, and will be disclosed to our advisers, prospective purchasers and new owners. They will have access to the information insofar as they comply with the our confidentiality undertaking, privacy policy and security measures.

 

Product notification

This is where we use your contact information to send information of services or products you have requested us mark as of interest to you, and from time to time we will mail, e-mail or SMS such information. As a user you will always have the option to indicate that you do not want to receive further product communication at time of receipt of the communication. The user will, however, continue to receive other (marked) product information until the option to not receive future communications has again been selected for such specific product.

 

Third parties

Except as outlined in the section dealing with “Sharing user information”, EB  will not sell or otherwise make available user information to other organisations for independent use.
